Our robots.txt file and any other technical access restrictions are incorporated into these Terms. Violation of robots.txt directives constitutes a breach of these Terms.

10. Reservation of Rights and Access Termination

16. Dispute Resolution

Informal Resolution

Before filing any formal legal claim, you agree to contact us at hello@moderncreatornetwork.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.

Arbitration Agreement

If we cannot resolve a dispute informally, you and Modern Creator agree to resolve any disputes through binding arbitration rather than in court, except that either party may bring claims in small claims court if eligible.

Arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in New York, or another mutually agreed location, or via telephone/video conference.

Class Action Waiver

YOU AND MODERN CREATOR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION.

Exceptions

This arbitration agreement does not apply to:

• Claims for injunctive relief
• Claims related to intellectual property rights
• Claims that must be brought in a specific forum by law

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.

18. General Provisions

Entire Agreement
